Protecting Japanese investments in Mexico
This newsletter considers recent developments in the Mexican energy sector and how they might impact Japanese investors. In the last two years, the administration of Mexican President López Obrador has made repeated attempts to tighten legislative controls on international investment. These amendments stand in stark contrast to Mexico’s December 2013 reform of the regulatory framework which opened the energy market to international investment and ended the then-existing state monopoly (“2013 Energy Reform”). In early 2021, the Mexican Congress passed an amendment to the Electricity Industry Law; however, the Mexican Supreme Court initially blocked its implementation. He has particular expertise in contentious proceedings involving post-M&A, commercial, manufacturing, construction, and distribution matters, in areas such as life sciences, automotive, and energy. Lars also deals with cases involving governments, and has advised foreign investors and sovereign states on issues of foreign direct investment and public international law, including related negotiations and investor-state disputes. He has been involved in more than 50 international arbitrations as counsel and arbitrator under the arbitration rules of institutions such as the ICC, DIS, SAC, NAI, ICDR, KCAB, JCAA, SIAC, and ICSID, as well as under the UNCITRAL Rules.
