Firm's Approach to Conflict of Interest
As the firm is becoming larger in scale and the number of our clients is increasing, Nishimura & Asahi occasionally receives contacts from a client regarding a case involving an interest that conflicts (or potentially conflicts) with another client's interest.
In accordance with the Attorney Act and the Japan Federation of Bar Associations' Basic Rules on the Duties of Practicing Attorneys, our firm's internal rules and information management systems are organized to deal with the conflict issue related to the clients' interest.
As a procedure to ensure protection of the client's interest and fairness of our duties, before officially taking on a case, we conduct internal investigation to confirm whether there is any actual or potential conflict of interest. Where a proposed case inquired by a client contains any actual/potential conflict of interest, we ensure the fairness of our duties by ways of such as dividing the attorneys in charge of each case into groups and establishing firewalls so that the attorneys who are involved in one case may not get access to the information relating to the other conflicting cases.
We also organize a committee consisting of attorneys specialized in various areas to conduct follow-up check of compliance with rules and a review of the current internal policies.
