We have a great deal of experience in providing legal services including civil and criminal legal actions against various acts of unfair competition, such as for the protection of trade secrets and data, and the protection of product name and business brand.

The Unfair Competition Prevention Act of Japan provides for various types of acts, such as the illegal acquisition and use of trade secrets and the use of well-known and famous products and business indications. Protection of unregistered IP such as the protection of know-how or other technical information that is not patented, and the protection of unregistered brand and design are both becoming key considerations for many companies. Nishimura & Asahi has a great deal of experience in advising clients on preparing relevant internal rules or other frameworks for protecting such information, so that the information can fall within the scope of protected trade secrets and other data under the Unfair Competition Prevention Act, and enable civil or criminal actions against any theft or misappropriation of such information. We also handle actions against the unauthorized use of brands as an indication of the business of a third party, or against the unauthorized sale of a third party’s goods that imitate the configuration of a brand, and other actions under the Unfair Competition Prevention Act.
