In a case where a consumer sues a company regarding the products or services the company provides and where many consumers have suffered the same damage from the products or services, the company needs to respond in a cautious manner because it may face a series of suits for damages in addition to the injunction as described above in the section on the Consumer Contract Act.
The Act on Special Measures Concerning Civil Court Proceedings for the Collective Redress for Property Damage Incurred by Consumers came into effect in October 2016, based on which Specified Qualified Consumer Organizations may initiate a Japanese version of a class action lawsuit.
In addition, even if the Act is not applicable, a group of consumers may bring a consolidated lawsuit lead by a plaintiff lawyer.
