Bankruptcy

Armed with Wealth of Experience and Knowledge

Many of our attorneys have served, upon appointment by Japanese courts, as bankruptcy trustees for companies; most notable cases include Yamaichi Securities as well as SOGO (a major Japanese retailer) and eight of SOGO’s group companies, garnering market recognition and a reputation for our expertise. In furtherance to our expertise, we provide a number of services, including advice on debt collection, the filing of bankruptcy petitions for debtors, and we also represent creditors, vendors as well as buyers of debtors’ assets or businesses, providing a broad range of services in connection with bankruptcy proceedings.

Armed with this wealth of knowledge and extensive experience, we are up for any and all bankruptcy-related issues and we will provide the most appropriate advice, however difficult the situation may be. Issues with respect to which we provide our advice regularly include, actions to be taken when our client has concerns over its trade partner being on the verge of filing for bankruptcy, direct and indirect effects of our client’s subsidiary filing for bankruptcy to wind down the subsidiary, possible consequences to the interests of our client when a counterparty to a transaction files for bankruptcy, steps to be taken and advice on negotiations when a bankruptcy trustee exercises its right of avoidance, and whether or not a transfer of business within bankruptcy proceedings is possible.
